These terms apply to every contract between Next Boring Company B.V. (“we”) and a business customer (“you”) for the use of Next Configurator. The service is offered to businesses only.
1. The service
Next Configurator is a hosted software service: a 3D product configurator, quote requests and quotes, follow-ups, a sales pipeline, production documents and a storefront that you can embed in your own website or run at your own domain. We may improve or change features at any time as long as the core service remains.
2. Account and store
You create a login and one or more stores. You are responsible for the content you publish, the prices you show, the quotes you send, and for keeping your login secure. Each storefront has its own subscription; a company may keep up to three storefronts offline while setting them up.
3. Price and payment
Each live storefront is its own subscription: €499 per month, or €4,999 per year, excluding VAT, billed in advance through Stripe by card, SEPA Direct Debit or iDEAL (other currencies at the amounts shown when you subscribe). EU businesses with a valid VAT number are reverse-charged. The first storefront of a company starts with a 14-day free trial: a payment method is saved, nothing is charged until the trial ends, and you can cancel before that date at no cost. Additional storefronts are charged from the day they go live.
Subscriptions renew automatically at the end of each period until cancelled. If a payment fails we notify you and retry; the storefront stays online for 5 more days, after which it goes offline (“opening soon” for visitors, your admin keeps working) until the balance is settled.
4. Term and cancellation
You can cancel at any time from the billing page, in one click, without giving a reason; the storefront stays online until the end of the period already paid (or until the trial ends) and no further charge is made. A yearly subscription cancelled within 14 days of its first charge is refunded in full. We can terminate with one month’s notice, or immediately in case of abuse, illegal content or non-payment. After termination you can export your data for 30 days; then it is deleted.
Where a charge is disputed or a refund is requested outside the cases above, we settle pro rata: the unused part of the period is refunded, less the costs we have incurred for running the storefront during the period (hosting, payment and transaction fees, support). We never charge for time after a cancellation takes effect.
5. Your content and data
You keep all rights to your product data, prices, quotes and customer data. You grant us the licence needed to host and display it. We process personal data of your customers as your processor under the data processing agreement in section 9.
6. Acceptable use
No illegal content, no misleading prices or quotes, no attempts to breach the platform or other tenants, no mass mailing beyond the follow-up features provided. We may suspend a store that breaches this.
7. Availability and support
We aim for 99.5% monthly availability excluding announced maintenance. Support is by email on working days. We back up data daily.
Help assistant: subscriptions include the help assistant in the admin, with a fair monthly number of questions. It explains the platform and points the way; it does not change your store. Paid subscriptions (and those we gifted) can also hand a question to our team (“Ask the team”); we answer in the admin on working days and email you when the answer is ready. Help chats are kept as described in the privacy policy (deleted 12 months after their last use).
8. Liability
Our liability per contract year is limited to the fees you paid in that year. We are not liable for indirect damage, lost profit or lost data beyond our backups. Nothing limits liability for intent or gross negligence.
9. Data processing agreement
For personal data you process through the service, we act as your processor: we process it only on your instructions (the use of the service), keep it confidential, apply appropriate security measures, use the sub-processors listed in the privacy policy, assist you with data-subject requests, and delete or return the data at the end of the contract. You may audit compliance once a year on reasonable notice.
10. Law and disputes
Dutch law applies. Disputes go to the competent court in Amsterdam.
